After the working drawings and Specifications for a project are completed by the Architect and a Detailed estimate is prepared, the next stage is selection of a Contractor. The process of asking for offers from Contractors is called Tendering. The dictionary meaning of the word ‘To Tender’ is ‘To Offer”.
According to Section 2(A) of the Indian Contracts Act, 1872, when one person signifies to another his willingness to do (or to abstain from doing anything,) with a view to obtaining the assent of that other to such act (or abstinence), he is said to make a proposal. When we call for offers from Contractors to build as per the drawings and specifications prepared by the Architect, we are asking Contractors to make such a proposal, as envisaged by the Indian Contract act, for doing so. Owners acceptance of such a proposal or offer or tender will result in a Contract.
