After the working drawings and Specifications for a project are completed by the Architect and a Detailed estimate is prepared, the next stage is selection of a Contractor. According to Section 2(A) of the Indian Contracts Act, 1872, when one person signifies to another his willingness to do (or to abstain from doing anything,) with a view to obtaining the assent of that other to such act (or abstinence), he is said to make a proposal. When we call for offers from Contractors to build as per the drawings and specifications prepared by the Architect, we are asking Contractors to make such a proposal, as envisaged by the Indian Contract act, for doing so. Owners acceptance of such a proposal or offer or tender will result in a Contract.
