Code of Conduct

Historically the profession of architecture, like many other professional guilds, was a self-regulated profession. The members of the professional guilds would adjudicate, in case of any disputes between members of the guild.

Need for Code

Historically the profession of architecture, like many other professional guilds, was a self-regulated profession. The members of the professional guilds would adjudicate, in case of any disputes between members of the guild. Similarly, professional organizations of Architects would adjudicate, in case of disputes between architects, or disputes between architects and others.

Prior to the passing of the Architects Act in 1972 and creation of Council of Architecture (COA), professional conduct of architects was regulated by the Indian Institute of architects. However, since the Indian Institute of architects is not a statutory body, it did not have the force of law behind it, for implementing any kind of professional misconduct enquiry, or any kind of action against an architect, found to be guilty of professional misconduct. After the passing of the Architects Act 1972, it is the responsibility of COA, to regulate standards of practice to be complied with, by the practicing architects.

Section 22. Of the Architects Act

The Council may by regulations, prescribe standards of professional conduct and etiquette and a code of ethics for architects.
Regulations made by the Council under sub-section (1) may specify which violations thereof shall constitute infamous conduct in any professional respect, that is to say, professional misconduct, and such provision shall have effect, notwithstanding anything contained in any law for the time being in force.

And therefore, in exercise of the powers conferred by sub-section (1) read with clause (i) of sub-section (2) of Section 45 of the Architects Act, 1972 (Act No. 20 of 1972), the Council of Architecture, with the approval of the Central Government, made the ARCHITECTS (PROFESSIONAL CONDUCT) REGULATIONS, 1989.These regulations promote the standard of professional conduct or self-discipline required of an Architect.
